What is final pay (back pay)?
When you leave a job in the Philippines — whether you resign or are separated — your employer owes you a "final pay" (often called back pay). It bundles together everything still due to you. Under DOLE Labor Advisory No. 06-20, it should be released within 30 days of separation.
What's usually included
- Unpaid salary for days already worked but not yet paid.
- Pro-rated 13th-month pay — your basic salary earned this year ÷ 12.
- Cash value of unused leave (Service Incentive Leave or company leave that's convertible to cash).
- Separation pay, if applicable (authorized-cause separation — see our separation pay calculator).
This estimate uses the standard daily-rate factor of 261 working days a year. Deductions (outstanding loans, accountabilities) are subtracted.
FAQ
Is final pay taxed?
It depends on the components. 13th-month and other benefits are tax-exempt up to ₱90,000; unused leave conversion has its own rules. Your employer computes the exact withholding, so treat this as a gross estimate. This is an estimate — verify the final figure with your employer or DOLE.
How long does an employer have to release final pay?
Under DOLE Labor Advisory No. 06-20, final pay should generally be released within 30 days of separation, unless a more favorable company policy, contract, or agreement applies. If it is delayed, you can raise the matter with your HR department or DOLE.
Does this include separation pay?
Only if you add it. Separation pay applies to authorized-cause separations (such as redundancy or retrenchment), not ordinary resignations. Use a separation pay calculator for that figure and include it here if it applies to your case.
How is the pro-rated 13th-month pay computed?
It is your total basic salary earned during the calendar year divided by 12. So if you leave partway through the year, you receive only the portion you earned, not a full month's pay.
